Virtually every boat in the Berkeley Marina with a tipped-up outboard is being undercharged for its berthing fees.

According to the Marina Ordinance, it makes no difference whether space is taken up by solid hull or by rails, booms, anchors, rudders, outboard motors or propellers. They all restrict the navigable width of the fairway, and they should all be measured and charged equally.

Estimates of lost annual revenue are as high as $50,000.
