To whom it may concern: On March 14, 2013 a rewritten letter similar to the one below was mailed to Mr. Bill McHugh owner of The Heights Tavern. The letter was sent certified, so I received a signed receipt the following day. Included in the letter was my email address for him to respond back. Since then I have yet to recieve a response. Business: Heights Tavern Owner: Mr. Bill McHugh Address: 3377 Adams Ave. San Diego Ca. 92116 Phone: 619-501-3455 To Bill McHugh: My name is Evelyn Rogers and I am blind. I have a seeing eye dog from Seeing Eye Inc., Morristown N.J. On March 4, 2013 John Errett and I decided to check out the new business in the neighborhood. Before I continue, I would like to state that I have been a resident of Normal Heights for almost twenty years. My dog and I have frequented many of the businesses along Adams Ave. from Park Ave. to Kenzington. I have never had a major problem with any of the businesses mentioned above. Once in a while I have had to say, my dog is a guide dog...end of story. But,on Monday afternoon John Errett, my dog, and I were starting to leave; your employee Nino Nunziante approached us asking for: 1. Documentation and/or registration information on my dog. And 2. telling me that I have to sit on the patio because of my dog. I quickly responded by telling him that my dog is a service dog, and I didn't have to provide documents and/or registration information according to the laws. Mr. Nino Nunziante is absolutely in the wrong by asking. I continued by telling Mr. Nino Nunziante to get on a computer, and read the (ADA) laws to get informed.Mr. Nino Nunziante left for approximately ten to fifteen minutes. After returning Mr. Nino Nunziante attempted to ask me the two, and only questions that can be asked. By this time I was thoroughly upset.Mr. Nino Nunziante, who has no legal justification intentionally interfered with the use of a guide dog by intimidating me the guide dog user. This is also againest the law. I asked Mr.Nino Nunziante for a written apology. He responded by saying, I didn't need one. Again, I am asking for a written apology. Because, Mr. Nino Nunziante's behavior towards us was unacceptable and very bad customer service. Otherwise, I can and will file a complaint with the Department of Justice in Washington D.C. P.S. This version is my recollection of that incident, and was used to write the final letter that was mailed. Also, I would like to state that I am not interested in any free food, money, or coupons. Sincerely, Evelyn Rogers Phone: 619-528-9034 cell phone: 619-495-1986
